WAABAN CHAIR – TERMS OF SERVICE

Overview
Welcome to Waaban Chair. The terms “we”, “us” and “our” refer to Waaban Chair, operated by eSupply Canada Inc. These Terms of Service govern your use of our website, products, and services (the “Services”). By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Services.

Eligibility and Use
You confirm that you are the age of majority in your province or territory of residence and legally capable of entering into binding agreements. You agree to provide accurate, current, and complete information in all interactions and purchases and are responsible for maintaining the confidentiality of any account credentials.

Products
We make reasonable efforts to ensure that product descriptions, specifications, and images are accurate. However, variations in colour, materials, and finish may occur, and digital representations may differ from the final product. All products are subject to availability and may be modified or discontinued without notice.

Orders
Placing an order constitutes an offer to purchase. Orders are not accepted until confirmed by us. We reserve the right to refuse, cancel, or limit any order at our discretion, including in cases of pricing errors or inaccuracies. Once an order has been confirmed and released into production, it is final and cannot be cancelled or modified except as required by applicable law. All purchases are subject to our Returns and Warranty Policy, which forms part of these Terms, and in the event of any inconsistency, the Returns and Warranty Policy shall govern with respect to product-specific matters.

Pricing and Payment
All prices are listed in Canadian dollars unless otherwise stated and do not include applicable taxes or shipping charges. You agree to provide valid payment information and authorize all charges associated with your purchase.

Shipping and Risk
Delivery timelines are estimates only and are not guaranteed. Title to and risk of loss of products pass to you upon confirmed delivery to the shipping address provided at the time of order. We are not responsible for delays caused by carriers, customs, weather, or events beyond our reasonable control. We shall not be liable for any failure or delay in performance arising from events beyond our reasonable control, including but not limited to acts of God, supply chain disruptions, labour disputes, transportation interruptions, or governmental actions.

Intellectual Property
All content on this site, including designs, images, branding, and product materials, is the property of Waaban Chair, eSupply Canada Inc., or its licensors and may not be used or reproduced without prior written consent.

Third-Party Services
Our store is hosted on Shopify; however, all transactions are between you and Waaban Chair, and Shopify bears no responsibility for any products, services, or transactions.

Privacy
Your personal information is handled in accordance with our Privacy Policy and applicable Canadian privacy laws, including PIPEDA, and may be processed outside of Canada where necessary to provide the Services.

Feedback
Any feedback or submissions provided to us may be used without restriction or compensation, and you confirm that you have the right to provide such content.

In all cases, total liability shall not exceed the amount paid for the product giving rise to the claim.

Indemnification
You agree to indemnify and hold harmless Waaban Chair, eSupply Canada Inc., and its affiliates from any claims, damages, or expenses arising from your misuse of the Services, breach of these Terms, or violation of applicable law.

Termination
We may suspend or terminate access to the Services at any time. All obligations incurred prior to termination remain enforceable.

Governing Law
These Terms are governed by the laws of the Province of Ontario and the laws of Canada applicable therein. Any disputes shall be resolved in the courts of Ontario.
